Copyright Notice
From Tim Whelan

All the text and pictures on this web site (http://www.tgw.net) are copyright 1983-2000 Tim Whelan. All rights reserved.

Printing of photos for personal use
If you want a copy of one of my pictures to stick on your fridge or use in a school project or cover a crack in your wall, then please feel free to print anything you like from my site. If an image has an integrated copyright notice (usually in the right- bottom corner), I ask that you print your image so that the notice will display.

Non-commercial Web use of photos
If you have a personal home page or non-commercial Web service, please feel free to use my photographs with hyperlinked credit. Acceptable HTML is:

photographs courtesy <a href="http://www.tgw.net">TGW.NET</a>
That way people know who took the picture and also can find my on-line copyright statement. You do not need to pay for usage. Just build the best Web site you can and give it back to the community.

Commercial Web use of photos
If you would like to use my pictures on a commercial page, then please do the following:
  1. Please email me for permission to use images. Non-response does not equate to permission.
  2. Add the hyperlinked credit as above.
  3. I reserve the right to deny usage at any time.
Note: remember that most of the pictures of people on my pages are not model-released. Advertising usage of photos (e.g., brochures, catalogs, print ads) is very different from editorial usage of photos (e.g., newspaper and magazine articles, books). You cannot use pictures in advertising (e.g., an on-line product brochure or anything else that is selling) without getting a model release from any person whose image is recognizable in the photo. You might also have problems if an image contains a recognizable physical property. One of the reasons advertisers pay $1000+ for images from stock agencies is that those agencies have generally already gotten the relevant releases.

Non-commercial use of Text and Stories
Please feel free to redistribute via hardcopy or email for noncommercial purposes any of my writings, but please don't break up documents (except by chapter) and please attribute the source in such a way that someone can find the most up-to-date version on my web site. If you want to copy my (text) content to your own non-commercial web server, please follow the guidelines outlined below in 'Commercial Web use of Text and Stories'.

Commercial Web use of Text and Stories
I am happy to have you use portions of my text and stories on your commercial page, however, I want people to come to my site to read the full story. If you would like to use my text and stories on a commercial page, then please do the following:
  1. Please email me for permission to use text or stories. Non-response does not equate to permission.

  2. You may only post approximately 10% of any one of my stories on your web server. For example, Around Vancouver Island has six chapters and four appendixes. Therefore, you can post approximately one chapter on your web server—readers should come to my site if they want to read more.

  3. Include the following link button on your web site where you have posted 10% of my stories/text. The button should be placed at the top of the excerpt of the story.

Here is the appropriate HTML for the button:
    <a href="http://www.tgw.net"><img src="linkbutton.gif" width="88" height="31" border="0"></a>
  4. I reserve the right to deny usage at any time.
Use of photos and Web pages in print
If you are doing a story, book, or CD-ROM about the World Wide Web, please feel free to include a page or two of mine. Three requirements:
  1. The URL must be legible in the capture or separately printed in a caption
  2. A small credit must be printed reading "Web page courtesy Tim Whelan (www.tgw.net)" or "Photos courtesy Tim Whelan (www.tgw.net)"
  3. Send me email informing me of the usage and where I can read/see it
If you simply want to use my photographs to illustrate an article that is not about my Web pages, e.g., you want a whale photo to go with a story on whales, then that is commercial usage, you are not covered by any of these blanket licenses, and you should send me email with a proposal. Please note, I do have available high-resolution versions (up to 3072x2048 pixels) of all images on this site. I have captions and locations for almost all images. The high-resolution version of the images are excellent for print/press use. I am willing to license the high-resolution images—again, please send me an email if you are interested. An exception to this is free publications put out by non-commercial organizations; you guys can use whatever you want with credit as above.

The base verbiage for this copyright notice was taken (with permission) from Philip Greenspun's web site.
